Terms of Use

Welcome to GoldenRatioFit! These Terms of Use ("Terms") govern your use of the GoldenRatioFit iOS application (the "App") and any related services provided by GoldenRatioFit ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By creating an account, downloading, installing, or using GoldenRatioFit, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and GoldenRatioFit.

2. Eligibility

2.1 Age Requirement

You must be at least 13 years old to use GoldenRatioFit. If you are under 13, you may not download, access, or use the App. By using the App, you represent and warrant that you are at least 13 years of age.

2.2 Health and Fitness

You should be in good physical health to use the workout programs provided in the App. If you have any pre-existing medical conditions, injuries, or health concerns, consult a healthcare professional before starting any exercise program.

3. Account Registration

3.1 Apple Sign-In

GoldenRatioFit uses Apple Sign-In for authentication. When you sign in:

• You may choose to share or hide your email address
• Your account is linked to your Apple ID
• You are responsible for maintaining the confidentiality of your Apple ID
• You are responsible for all activities that occur under your account

3.2 Account Security

You are responsible for maintaining the security of your account. Notify us immediately at support@goldenratiofit.com if you suspect any unauthorized access to your account.

4. Subscription Terms

4.1 Auto-Renewal

GoldenRatioFit offers subscription plans that automatically renew unless cancelled:

• Subscriptions are billed through your Apple ID
• Payment will be charged to your Apple ID account at confirmation of purchase
• Eligible new subscribers receive 14 days of full access at no charge during the free trial
• Unless cancelled at least 24 hours before the trial ends, billing begins automatically at the selected weekly, monthly, or yearly rate
• Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period

4.2 Cancellation

You can manage and cancel your subscription through your Apple ID account settings:

• Go to Settings > [Your Name] > Subscriptions on your iOS device
• Select GoldenRatioFit
• Tap "Cancel Subscription"

Cancellations take effect at the end of the current billing period. You will continue to have access to premium features until the subscription expires.

4.3 Refunds

All purchases are final and non-refundable, except as required by applicable law or as determined by Apple's App Store refund policies. We do not process refunds directly—please contact Apple Support for refund requests.

4.4 Price Changes

We reserve the right to change subscription prices. Any price changes will take effect at the start of the next subscription period after the change. You will be notified of any price changes in advance.

5. User Content

5.1 Your Content

You retain ownership of all content you create or upload to the App, including:

• Progress photos
• Body measurements and health data
• Workout logs and notes

5.2 License to Us

By uploading content to the App, you grant us a limited, non-exclusive license to use, store, and process your content solely for the purpose of providing and improving the App's services. This license ends when you delete your content or account.

5.3 Content Responsibility

You are solely responsible for the content you upload. You represent and warrant that:

• You own or have the necessary rights to the content you upload
• Your content does not violate any third-party rights
• Your content is accurate and truthful

6. Acceptable Use

You agree not to:

• Use the App for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App or servers
• Share your account credentials with others
• Use the App to harass, abuse, or harm others
• Upload viruses, malware, or other harmful code
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices from the App
• Use automated systems to access the App without our permission

7. Health Disclaimer

7.1 Consult Your Doctor

Always consult with a qualified healthcare provider before:

• Starting any new exercise program
• Making significant changes to your diet
• Taking any supplements or medications
• If you have any pre-existing medical conditions
• If you are pregnant, nursing, or have a history of eating disorders

7.2 Assumption of Risk

You acknowledge that physical exercise involves inherent risks, including but not limited to:

• Physical injury, strain, or discomfort
• Cardiovascular stress
• Muscle soreness or damage
• Dehydration

By using the App, you voluntarily assume all risks associated with physical exercise and agree that GoldenRatioFit is not responsible for any injuries or health issues that may result.

7.3 Supplement Tracking

The supplement tracking feature is provided for informational purposes only. We do not endorse, recommend, or provide medical advice regarding any supplements, including performance-enhancing substances. Always consult a healthcare professional before taking any supplements.

8. Intellectual Property

8.1 Our Content

The App and its content, including but not limited to text, graphics, logos, icons, images, audio clips, software, and workout programs, are owned by or licensed to GoldenRatioFit and are protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. This license does not include:

• Modifying or copying the App materials
• Using the materials for any commercial purpose
• Attempting to decompile or reverse engineer the App
• Removing any copyright or proprietary notations
• Transferring the materials to another person or mirroring the materials on any other server

8.3 Golden Ratio

The mathematical concept of the golden ratio (φ ≈ 1.618) is in the public domain. However, our specific implementation, algorithms, branding, and content are our intellectual property.

9. Termination

9.1 By You

You may stop using the App and delete your account at any time through the App settings. Upon deletion, your data will be removed in accordance with our Privacy Policy.

9.2 By Us

We reserve the right to suspend or terminate your account and access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

9.3 Effect of Termination

Upon termination:

• Your right to use the App immediately ceases
• Your subscription will not be automatically refunded
• Provisions of these Terms that by their nature should survive termination will survive

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• GoldenRatioFit shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability to you for all claims arising from or related to the App shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not liable for any loss or damage arising from your failure to comply with these Terms
• We are not liable for any third-party services or content accessed through the App

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, timely, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• Any errors in the App will be corrected

12. Indemnification

You agree to indemnify, defend, and hold harmless GoldenRatioFit and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from:

• Your use of and access to the App
• Your violation of any term of these Terms
• Your violation of any third-party right, including intellectual property or privacy rights
• Any claim that your content caused damage to a third party

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our App after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the App.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

15. Dispute Resolution

Any disputes arising out of or relating to these Terms or the App shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved informally, it shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

16. Third-Party Beneficiaries

Apple Inc. is a third-party beneficiary of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and GoldenRatioFit regarding the App and supersede all prior agreements and understandings.
